2.1 Use of the Website
By accessing this website, Discord, or any Herman Trading product, you agree to use the information and tools available responsibly, and only for personal, non-commercial purposes.
2.2 No Guarantees
We make no warranties or guarantees about the accuracy, reliability, or completeness of the information provided. All content is offered “as is,” without any representations.
2.3 Intellectual Property & Copyright
All Herman Trading products – including, but not limited to, TradingView indicators, Pine Script™ code, backtest data, analytical tools, graphics, statistical reports, and educational materials – are protected by copyright law and remain the sole property of Herman Trading.
2.4 Licensing of Indicators
When you purchase access to Herman Trading premium indicators, you are granted a personal, non-exclusive, non-transferable license.
You are strictly prohibited from:
copying, modifying, reverse engineering, decompiling, or extracting source code,
reselling, sublicensing, or sharing access with third parties,
publishing, redistributing, or making the products publicly available in any form.
Indicators are provided in protected format (invite-only on TradingView).
Any attempt to bypass protections, duplicate our products, or replicate the innovative “historical probability data integration” concept without permission will result in immediate termination of access without refund and may lead to a DMCA takedown or legal action.
2.5 Protection of Innovative Concept
Herman Trading is the original creator of statistical-based TradingView indicators that integrate external backtest results directly into the TradingView user interface.
Examples include the London Probability Map, New York Probability Map.
This unique concept — combining long-term backtested data with real-time TradingView visualization — is a proprietary innovation of Herman Trading.
Any unauthorized copying, replication, or imitation of this idea or its implementation will be treated as an infringement of intellectual property rights.
2.6 Limitation of Liability
Herman Trading shall not be held liable for any losses, damages, or consequences arising directly or indirectly from the use of this website, its tools, indicators, or educational materials.
3. Privacy Policy
3.1 Information We Collect
We may collect limited information automatically (such as cookies, analytics data, or page usage statistics). This helps us understand how visitors use the website and improve user experience.
We record aggregate daily counts of page views and outbound Whop clicks, grouped by public page and broad referral category (Direct, Google, X, YouTube or Other). These counters contain no IP addresses, visitor identifiers, full referrer URLs or search terms, and do not use analytics cookies. They are retained for up to 365 days. The counter honours browser Do Not Track and Global Privacy Control signals and the “Reject analytics” choice. Counts are approximate and clicks do not confirm purchases. Hosting providers may separately process technical logs to operate and secure the service.
3.2 Use of Information
We do not sell or rent personal information. Technical service providers process information needed to operate the website, authentication and the AI service described below. Any collected data is used for those functions and to maintain and improve the service.
3.3 Cookies and optional analytics
Google Analytics 4 runs only after an explicit opt-in. It uses first-party _ga cookies for up to 180 days and receives page paths, browser/device and network information to measure visits. Google may process this information outside the UK. The website does not send AI messages, enquiry content, URL query strings, fragments or full referrers to Analytics. Enhanced measurement, Google signals and advertising personalisation are disabled.
“Reject analytics” is as accessible as acceptance and does not affect access to the site. Use “Analytics settings” on any public content page to change or withdraw consent. Withdrawal stops future Google collection and removes the site’s Analytics cookies; it does not automatically erase data already processed. Your preference is stored in your browser for up to 180 days. Do Not Track and Global Privacy Control keep Analytics off. See Google’s privacy policy for its processing and safeguards.
3.4 Your Rights (Global Privacy)
Regardless of where you are located, you have the right to request access to, correction of, or deletion of your personal data, subject to applicable privacy laws in your region.

3.5 How This Website Works
This website is hosted through ChatGPT Sites. OpenAI and its infrastructure providers process requests and operational data to deliver and secure the service. When you use ChatGPT sign-in, the website receives an account identifier, email address and, when supplied by the platform, an account name. The editor uses the account identity to restrict editing to the authorised owner; it does not publish that identity.
The website remembers your light or dark theme in your browser. Sign-in may use essential authentication cookies managed by the hosting platform. Google Analytics is optional and is not loaded until you choose “Accept analytics”. Advertising features are disabled.
When Ask Herman AI is available, your message and recent conversation context are sent to OpenAI through its API to generate an answer. The website does not save chat transcripts and requests that responses are not stored as retrievable API objects. OpenAI may retain data under its API data policies, including for abuse monitoring. The website keeps aggregate daily request counts and temporarily uses connection information to limit abuse. Do not include passwords, account credentials or sensitive financial information. Starting a new conversation clears the on-screen conversation, not records held by service providers. Contact Herman Trading with privacy questions or requests.
Subscriptions and payments are completed on Whop. Links to Whop, NinjaTrader, Kinetick, social networks and the learning terminal open services with their own privacy policies. This website does not collect payment-card details.
4. Enforcement & Violations
In case of any violations of these Terms (such as copying, reverse engineering, or reselling indicators):
Herman Trading reserves the right to immediately revoke access without refund,
file a DMCA takedown with TradingView, Whop, or any relevant platform,
pursue legal action to protect its intellectual property.
We take intellectual property seriously. Please respect the work, innovation, and research behind our tools.
